# The Copyright Problem AI Art Still Can't Solve
Every major image model can make something slick in seconds. That is no longer the hard part.
The hard part is proving what the model was allowed to learn from, what rights you actually have in the output, and who carries the risk when a rightsholder objects. On July 23, 2026, that problem is still unresolved across the AI tools market, and the gap between marketing language and legal certainty remains wide.

Why this still is not solved
AI image companies keep trying to compress the debate into a trust slogan. “Commercially safe,” “licensed,” and “creator-friendly” sound decisive.
They are not decisive because copyright law asks different questions than product pages do.
1. Training legality is still being fought
The biggest unresolved issue is whether model training on copyrighted images is licensed, fair use, infringing, or some mixture depending on the facts. The [U. S.

country=1049) now links a pre-publication Part 3 report released on May 9, 2025, and the Office did not bless blanket scraping.
Its position is more careful than vendor marketing. The Office says copying can occur during dataset building and training, and fair use turns on specifics such as the works used, the purpose, and the market effect.
That matters because most buyers do not buy models in the abstract. They buy legal exposure attached to workflows.
2. Output risk is separate from training risk
Even if a vendor eventually wins a training fight, output risk remains. A model that can generate something very close to Darth Vader, Elsa, or the Minions still creates a downstream problem for the user.
That is why the June 11, 2025 lawsuit from Disney and Universal against Midjourney matters.
The case is not just about what went into training. It is also about what came out.

3. “You own it” does not mean “it is copyrighted”

OpenAI’s Terms of Use say users own output as between user and vendor, to the extent allowed by law. Midjourney’s [Terms of Service](https://docs.

Those are useful contract terms. They are not a shortcut around human authorship doctrine.

The cleanest way to read this market is not “best image model.” It is “best risk profile for the job.”

The most important divide is not image quality. It is whether the tool is built like a creator community, a governed enterprise platform, a stock licensing layer, or a model you operate yourself.
That is why “best AI art generator” lists are usually shallow. They collapse four very different buying decisions into one leaderboard.

Where the marketing overreaches
The loudest overreach is the claim that a model is “commercially safe” in a general sense. That phrase hides exclusions.
Adobe’s public materials say Firefly is trained on public-domain and licensed content and that enterprise customers can get IP indemnification for eligible outputs. That is meaningful.
It still does not mean every output is protected, every feature is covered, or every jurisdiction will read the same facts the same way. Adobe’s own product descriptions limit which features, surfaces, and release states qualify.
The second overreach is “you own your output. ” You may have contractual ownership against the vendor, but the [Copyright Office’s guidance](https://www. govinfo.
gov/app/details/FR-2023-03-16/2023-05321) and the January 29, 2025 report make clear that prompts alone usually do not supply enough human authorship.
The third overreach is treating training transparency as optional. It is not optional if you are a publisher, advertiser, studio, or platform operator that may need to defend provenance later.
If a vendor cannot clearly explain training sources, exclusions, and how it handles high-risk prompts, that is not a PR gap. It is a procurement problem.
The practical use-case split
This is where serious adoption decisions get easier.
Good fits right now
AI art tools are useful for internal concepting, campaign roughs, layout exploration, background ideation, thumbnail generation, pitch decks, storyboards, and other work where speed matters more than exclusivity.
They also fit controlled production tasks when the vendor offers stronger provenance and indemnity, and the organization keeps human editing in the loop. Think ad variants, packaging mockups, blog illustrations, and placeholder brand art with review gates.
Bad fits right now
These tools are poor fits for mascot creation, franchise-adjacent illustration, celebrity likeness work, logo-heavy scenes, licensed character work, or any hero image where uniqueness and defensibility matter more than speed.
They are also a weak choice for confidential campaigns if the workflow runs through a public or semi-public product. Midjourney’s docs explicitly say content is public and remixable by default, and even Stealth has important caveats depending on where generation happens.
The hidden workflow constraint
A lot of teams still price these products as if the monthly subscription is the cost. It is not.
The real cost is prompt logging, rights review, asset screening, moderation, legal escalation, and human cleanup. The cheaper the tool looks on the pricing page, the more likely those costs were pushed onto you.
Security review is not separate from copyright review
This is where many rollouts fail. The wrong product can be legally acceptable on paper and still unusable in practice.
Midjourney is the clearest example. Its plan docs say Stealth mode requires Pro or Mega, and its group billing docs say it does not offer SSO, seat or admin management, or participation in supplier security processes.
That is a serious blocker for agencies, newsrooms, and larger brands. If a tool cannot pass procurement, its image quality is irrelevant.
OpenAI takes the opposite path for business users. Its enterprise privacy commitments say business data is not used to train models by default, and the [service terms](https://openai.

That is stronger for governed internal workflows. It still requires the customer to handle inputs, approvals, and trademark or publicity review.

If you are choosing among ai tools for image work, stop asking which one “wins.” Ask which one fails safely for your use case.
Use this checklist:

- •Require a human-authored layer if you need a protectable final asset. Composition, editing, paintover, selection, and arrangement matter more than prompt poetry.
- •Ban prompts targeting famous characters, logos, or public figures unless there is an explicit licensed use case.
- •Demand written answers on training provenance, data retention, public visibility, admin controls, and indemnity exclusions.
- •Keep a paper trail. Save prompts, source files, edit history, approval notes, and export versions.
That last point sounds tedious. It is also what turns a hand-wavy AI workflow into something a legal team can defend.
